Privacy Policy

This Privacy Policy was last modified and is effective as of 25th July 2021.

This privacy policy ("Privacy Policy") describes how Benjamin Moore UK Ltd. (formerly Shaw Paints Ltd) ("Benjamin Moore," "we," "us," or "our") handles certain personal data that we collect via our website www.benjaminmoorepaint.co.uk, its subdomains, and other pages, sites or mobile applications which provide an authorized link to this Privacy Policy (collectively, "Sites"). This Privacy Notice also describes how you may exercise your rights or contact us with questions or concerns regarding our Processing of your personal data.

Who is responsible for your data

This Privacy Policy refers to the personal data collected by Benjamin Moore UK Ltd., a private limited company registered in England and Wales under the company number 9573012. Our Registered office is 804 Oxford Avenue, Slough, SL1 4LN.

For the purposes of applicable UK and EU privacy law, we are the "data controller." Our registration with the ICO Data Protection Register is ZA349035.

Personal Data we process

We collect and process the following types of personal data:

  1. Your name, your postal address, telephone number, email address or social media account ID. This personal data is collected when you create an account on our Sites, purchase a product on-line, over the telephone or in one of our stores, attend an event such as a Trade show or training event, enter any promotion or competition, or communicate with us via any channel to ask us to send you information about our products or services.
  2. Your username and password for our Sites. When making order on our Sites or over the telephone, we will create an account profile for you which is accessed by a username and password. Our employees have access to your username but your password is held on a secure server and is not visible to employees.
  3. Information about your order history. We retain personal data about the products, colours, finishes and volumes that you have purchased. We do not retain any payment card details.
  4. Correspondence between us. We retain electronic or physical copies of correspondence between us, be it via email, letters, telephone calls or messages on our various social media channels.
  5. Personal Data about your project, home or business. In order to offer the best advice, we may sometimes ask for information relating to the project, your home or your business.
  6. Product reviews. When you submit a product review on our Sites, your review will appear alongside your name. No other personal details will be visible or made available.
  7. Personal Data about how you use our Sites and social media platforms. When you navigate on our Sites or our social media pages, we use tracking software to understand how our Site and social media platforms are being used. Please see our cookie and tracking technologies statement below.
  8. Sensitive Personal Data. We do not intentionally collect or process any data that is considered "special categories of personal data", as defined by Art. 9 of the GDPR.

Payment card information

Card payment transactions will be processed by a third party payment provider. We, with support from our authorized third party payment provider, will only use your payment information to process your payments to provide you with the products or items you ordered through our Site and telephone. Our current payment provider is Barclaycard, but this may change from time to time.

For our Sites and email payments, your credit/debit card details are entered directly into Barclaycard's secure payment portal and never revealed to us. Barclaycard encrypts your credit/debit card information and operates a secure server.

For telephone payments, you credit/debit card details are entered directly into Barclaycard's secure payment portal by a member of Benjamin Moore staff. They do not record your card details in any other way and once the payment is processed, card details are no longer available to staff members.

Links to other sites

Our Sites may contain links to third party websites not operated by Benjamin Moore. If you follow a link to another website from one of our Sites, you should note that those websites will have their own private policies, cookie policies and terms and conditions. We do not accept any responsibility or liability for the policies of third party websites.

Security of your Personal Data

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.

We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
